Access to the XIMICA website is free. Any person accessing the website is considered a user thereof. Users may decide to register in order to make purchases in the shop or contact us to ask questions or solve doubts. In all cases XIMICA advises against transferring to or sharing the account with third parties, albeit temporarily. The user agrees to make an adequate use of their access credentials and to keep them secret, bearing all responsibility arising from their disclosure to third parties.
In the personal area ‘My account’, the user can manage their personal data, the email address and password used to validate access, and the addresses provided for the delivery of orders.
3. Adequate use of services
The user agrees to use the services in an adequate, correct and lawful manner and therefore expressly accepts they are solely responsible for the use of the website.
The user is aware and voluntarily accepts that the use of the website is at all times under their sole responsibility, and agrees to use it correctly, in accordance with the law, good faith, public order and proper conduct. The user is liable to XIMICA or any third parties in case of damages arising from an inappropriate use of the content. Namely, the user agrees to refrain from: (i) Accessing the private accounts of other users or restricted areas of XIMICA and, where appropriate, from extracting information, violating intellectual or industrial property rights and the confidentiality of information; (ii) Impersonating other users; (iii) Obstructing the access of other users to the website and its services by means of the massive use of the computing resources used by XIMICA to provide its services; (iv) Reproducing, copying, distributing, making available or in any other way publicly communicating, transforming or modifying the content, unless duly authorised by XIMICA or the holder of the relevant content rights; and (v) Introducing computer viruses to the network or carrying out actions that may alter, damage, interrupt or create errors on electronic documents, data or physical and logical systems of XIMICA or third parties.
XIMICA ensures compliance with the applicable legal provisions at all times and is entitled to interrupt or restrict access to the services to users whose behaviour, according to XIMICA, is not compatible with morality, public order, proper conduct or which may affect the proper functioning, reputation or prestige of XIMICA.
The user is liable for all direct or indirect damages suffered by XIMICA arising from non-compliance with any of the obligations referred to in this legal notice, the relevant particular conditions or the legal provisions applicable to the use of the website.
4. Content
XIMICA is not liable for any typographical errors, inaccurate information or outdated information which may be found in its own content or content from third parties published on this website. XIMICA shall cease publication or remove from the website any content that violates intellectual or property rights or the business secrets of third parties, or that may constitute a crime or contravene applicable legal provisions or the principles set out in article 8 of Law 34/2002, of 11 July, on Information Society Services.
5. Intellectual property
All web content, such as texts, graphics, photographs, logos, icons, images, as well as the graphic design, source code and software, are the exclusive property of XIMICA or third parties whose rights are recognised by XIMICA and are subject to intellectual and industrial property rights protected by national and international law.
There is no transfer to the user of any intellectual or industrial property rights related to the website or any of its constituent elements. It is expressly prohibited to reproduce, transform, distribute, publicly communicate, make available, extract, reuse or use in any way and by any means any of those elements, except when permitted by law or duly authorised by the relevant right holder.
The user must abstain from obtaining, or attempting to obtain, web content by means or procedures other than those made available or indicated in each case or those normally used on the Internet.
Infringement of any of the aforementioned rights may constitute a violation of these provisions and may be considered a criminal offence pursuant to the Spanish Penal Code.
6. Exclusion of warranties and liability
XIMICA reserves the right to interrupt access to the website and the provision of any or all of the services provided through the website at any time and without prior notice, whether for technical, security, control, maintenance, power failure or any other reasons.
XIMICA declines all responsibility for any consequential damages or loss of profit arising from the interruption of services, delays, errors, malfunction and, in general, any inconvenience due to reasons beyond our control and/or wilful or negligent action of the user and/or due to force majeure. Without prejudice to the provisions of article 1105 of the Civil Code, force majeure also includes any event beyond XIMICA’s control, such as: failure of third parties, operators or service companies, government action, lack of access to third-party networks, action or lack of action by public authorities, consequences of natural phenomena, blackouts, etc. and attacks by hackers or third parties specialised in the security or integrity of computer systems, provided that XIMICA has adopted all the security measures available in accordance with the state of the art.
XIMICA declines all responsibility and offers no guarantees concerning the results obtained or in case of damages arising from the access to third-party services through connections or links to linked websites. The sole purpose of the links on XIMICA’s website is to inform the user of the existence of other sources of information online that can expand the services offered by the website. XIMICA cannot control the services provided by third parties, their lawfulness or their quality. The user must therefore exercise extreme caution when assessing and using the information and services existing in third-party content.
Although XIMICA adopts reasonably adequate measures to detect the existence of viruses, the user must be aware that the security measures of computer systems online are not entirely reliable. Thus, XIMICA declines all responsibility for any damages due to the presence in its content of viruses or other harmful elements that may alter the computer systems of the user and the documents or systems stored therein.
XIMICA is not responsible for the use made by the user of website services, passwords or any material related to the services that violates the intellectual or industrial property rights or any other rights of third parties.
Any exclusion of responsibility shall be understood without prejudice to the legal guarantees and protection applicable to the users who, according to the applicable provisions, have the legal status of consumers.

8. Applicable law and forum
This legal notice and the terms of use have been drafted pursuant to Law 7/1998, of 13 April, on General Contracting Conditions; Law 3/2014, of 27 March, modifying the recast of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Decree-Law 1/2007, of 16 November; and Law 34/2002, of 11 July, on Information Society Services and e-Commerce.
Any conflicts or disputes shall be resolved by the Courts and Tribunals of Madrid, except in those cases where the applicable forum corresponds to the domicile of the consumer.

These terms and conditions of sale, as well as any other particular conditions that may exist, duly displayed on the relevant screens, constitute the regulatory framework applicable to the purchase of our products through this website.
These terms and conditions of sale have been drafted pursuant to Law 34/2002 on Information Society Services and e-Commerce, Royal Law-Decree 1/2007, of 16 November, approving the recast of the General Law for the Defence of Consumers and Users, Law 7/1996 on the Regulation of Retail Trade and other complementary laws, all of which are mandatory legal provisions.
Only users over 18 years of age are allowed to purchase products through the website. Users must follow the steps and instructions provided during the purchase process, consisting of, but not limited to: (i) Completion of the identification form, both for occasional users and previously registered customers; (ii) On-screen display of the order summary, delivery conditions and applicable costs, including shipping costs; (iii) Acceptance of the purchase conditions, which implies that the user has read, understood and irrevocably accepted said conditions in their entirety, as well as, where applicable, the relevant particular conditions; and (iv) Immediate receipt of the summary email at the address provided for registration or, if not immediately, as soon as possible, always within 24 hours.
Customers who wish to register shall be assigned personal credentials consisting of a unique identifier (email address) and a password. The user is the sole responsible for the conservation and custody of said credentials and must treat them adequately, refraining from using other people’s credentials with the intent of impersonating other users while using the shop or any other service of the website.

4. Product information
Products available in the shop display all of their features, available options, price and an illustrative image. The catalogue may also contain a brief presentation of the product, as well as other products related to the product chosen by the user, who may decide to add them to the shopping cart.
Prices are indicated in euros (identified by the € symbol) and include VAT and any other applicable taxes at the current rate. The screen summarising the purchase also displays, where applicable, shipping costs to the user address. Shipping costs are always borne by the buyer.
The above paragraph does not apply to sales expressly excluded by value added regulations or to authorised sales for foreign countries.
We reserve the right to cancel a purchase when it has been made as a consequence of an obvious computer or typographical error. Said purchases shall be notified to the user as soon as possible, cancelling any debit to the user’s credit card.
The shop does not have a specific section for deals; however, products offered with a discount shall be duly indicated on the screen.
5. Payment methods
Once the products have been selected, before proceeding to payment prices and the total amount of the shopping cart, including shipping costs, are displayed. Payment can be made by credit card or PayPal. The transaction can be successfully completed following the instructions provided on the screen.
In order to process payments, we have contracted a payment gateway that meets the security standards required in e-commerce. All data transmitted are encrypted through HTTPS protocol to ensure maximum security, so transactions are guaranteed to be completed securely.
Purchased products are delivered as soon as possible to the address specified by the user in the order form. Generally, orders are delivered two-three days after the purchase date and, in any case, within 30 calendar days after the purchase date.

7. Returns and warranties (Right of withdrawal)
7.1 General terms
The user has the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period expires 14 calendar days after the day the contract was entered into. To exercise the right of withdrawal, the user must inform us of their decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email). The user may use the model withdrawal form below, but it is not obligatory.

The product must be in perfect condition, in its original packaging and properly stabilised (small or delicate products must incorporate additional packaging to avoid damage), including all accessories or gifts, where appropriate. Therefore, the user has to decide they want to keep the product before using it. Upon receiving the goods, and after checking they are in perfect condition, payment shall be reimbursed. The refund covers shipping costs, with the exception of the additional costs arising from selecting a delivery method other than the one initially determined as standard.
The legal deadline for the refund is 14 calendar days after the right of withdrawal has been exercised. After checking the condition of the product, the amount shall be refunded using the same method of payment chosen by the customer. If any element or packaging is missing, the product may be rejected and returned, indicating the reasons.
The following are considered exceptions to the right of withdrawal:
- The supply of goods made to the consumer’s specifications or clearly personalised.
- The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
7.2 Other exceptions and clarifications

- Products ordered directly from the manufacturer.
- Garments must be returned with their original labels and in perfect condition for the return to be approved.
In the event of non-conformity, the product may be returned for verification of the non-conformity. Non-conformity or damage due to transport, not visible at the time of delivery, may also occur.
Natural or legal persons acting outside the scope of their business or professional activity are considered consumers. Returns by withdrawal from companies, self-employed individuals or professionals are not accepted.
8. Applicable law
These terms and conditions are governed by Spanish law. Any conflicts or disputes shall be resolved by the Courts and Tribunals of Madrid, except in those cases where the applicable forum corresponds to the domicile of the buyer.
